為何我要訂立遺囑? WHY DO I NEED TO WRITE A WILL?

• 遺囑對每個人都很重要,確保親人在我們離世後得到照顧,並讓我們的意願得到尊重。訂立遺囑可以保障你摯愛的人。近來,不少人透過捐贈遺產以支持慈善團體,在他們的遺囑中包含有關機構作為遺產受益人之一,以繼續支持與他們價值觀相近的慈善工作。奧比斯視遺產捐贈為重要資源,因為捐款者的心意能讓我們繼續在世界各地進行消除可防治眼疾的工作。

• Your will is one of the most important documents you need to write. It ensures that your loved ones are looked after when you are no longer around and that your final wishes are respected.

Once your family and friends have been included, your will is also a way for you to continue to support the causes closest to your heart. More and more people today are including a gift to charity in their will to continue to support the valuable work they do. 如果我沒有遺囑,情況會怎樣? WHAT IF I DON’T HAVE A WILL?

• 如果你沒有訂立遺囑或你的遺囑無效,意味著你的意願可能無法實現。因此,訂立合時及專業的遺囑能確保身後安排如你所願。 

• If you do not have a will or your will isn’t valid, your estate is said to be intestate which means that your wishes may not be carried out. Having a professionally written, up to date will is the best way to ensure your requests are met.

誰應幫我撰寫或更改我的遺囑? WHO SHOULD HELP ME WRITE OR UPDATE MY WILL?

• 奧比斯建議你找律師代辦草擬或更新你的遺囑,確保其法律效力。

• Orbis advises that you use a professional will writer or solicitor to write or update your will to ensure that it is valid and witnessed.

如果我已經有遺囑,我需要在日後更新我的遺囑嗎? IF I ALREADY HAVE A WILL, DO I NEED TO UPDATE IT?

• 我們建議你定期檢視你的遺囑,以確保有關內容充份反映你的意願,尤其當你的個人及家庭狀況(例如婚姻狀況,住址或指定的遺囑受益人)有變。

• It is always a good idea to review your will periodically to ensure that it still reflects your wishes, especially if your personal circumstances (e.g. marital status, residential address or desired beneficiaries) have changed.

我應如何存放我的遺囑? WHERE DO I KEEP MY WILL?

• 你的遺囑是重要文件,請將它存放在安全的地方。常見方法是將遺囑與其他重要文件(例如你的退休金詳情和銀行賬戶)一同妥善保管,確保你信任的人知道遺囑存放位置。

• As your will is an important document it is essential that you keep it safe along with any other information such as your pension details and bank accounts. Please also ensure that someone you trust knows where you keep your will.

在訂立遺囑前,我應該準備甚麼文件? WHAT INFORMATION WILL I NEED TO GET STARTED?

• 你需要準備有關你、你的家庭成員、法定監護人、遺囑執行人和其他受益人的詳細資料,再加上有關你的資產和債務的狀況,以估算和決定有關的遺產價值。你也可以考慮列出任何對身後事的期望。

• Gather together details about you, your family, legal guardians, executors and any other beneficiaries. Have information to hand on your assets and liabilities, together this will give an estimate of the value of your estate that you may like your will to address. And consider any wishes you may have for your funeral.

何謂遺囑執行人?我應選擇誰作為我的遺囑執行人? WHAT ARE EXECUTORS AND HOW DO I CHOOSE THEM?

• 遺囑執行人是你在遺囑中指定為你處理遺產的人,他們會根據你在遺囑所訂立的意願處理遺產。我們建議你指定最少兩人作為遺囑執行人,以防其中一人無法處理你的遺產。你可以考慮選擇你的朋友、家人或事務律師作為遺囑執行人。

• Executors are people you appoint to ensure the wishes in your will are followed. It is recommended to name at least two people in case one person is unable to act for you. You may choose friends, family members or a solicitor.

我應如何選擇我的遺囑見證人? HOW TO SELECT WITNESSES FOR MY WILL?

• 見證人應該是你信任的人。你須指定兩位年滿 18 歲的人成為見證人並簽署你的遺囑。請留意他們或其配偶不可以是你遺囑的受益人,而每位見證人都必須同時出席及見證你簽署遺囑。

• A witness must be 18 years old or above, and someone that you trust. You should name two witnesses and both of them are available to observe that you are the one who sign your will. Please be reminded that the witness or his/her spouse should not be beneficiaries under your will.

何謂一般遺贈? WHAT IS A GENERAL BEQUEST?

• 一般遺贈清楚列明遺贈甚麼和遺贈予誰,並授權遺囑執行人自行訂定。

• General bequests describe exactly what you want to leave and to whom, while giving your executors the flexibility to decide from which source the funds are to be paid.

何謂特定遺贈? WHAT IS A SPECIFIC BEQUEST?

• 特定遺贈跟一般遺贈頗為相似,但特定遺贈須列明支付遺贈的來源,例如訂明將物業的某個百分比遺贈予奧比斯。

• Specific bequests are similar to general bequests but also specify from which source the funds are to be paid. For example, you may wish to leave Orbis a percentage of your property.

何謂剩餘遺贈? WHAT IS A RESIDUARY BEQUEST?

• 剩餘遺贈是指扣除所有支出和稅項,以及把遺產分配予家人後的遺贈。

• Residuary bequests are honoured after all other bequests to families have been made and all expenses and taxes have been paid from your estate.

何謂附條件遺贈? WHAT IS A CONTINGENT BEQUEST?

• 附條件遺贈是設定某些特定條件,在符合指定條件的情況下才會作出有關遺贈, 例如:你的第一遺產受益人先行辭世,你或會希望訂明下一位受益人。

• Contingent bequests are only made if certain conditions are met. For example, if your principle beneficiary does not survive you, you may wish to indicate your next choice through a contingency designation.
